Acceptable Use Policy — All Website Design & Development Services

1. Scope

These Terms are applicable to all the website design, website development, maintenance, and other associated digital services (collectively referred to as Services) offered by Riyans WebTech. Any mention in earlier drafts of web hosting has been eliminated or changed; hosting is never a part of standard design and development services unless it is confirmed in writing.

2. Spam, Warez, Piracy and Illegal Activities

Use of its Services to publish, facilitate or create illegal content or activities is not permitted in Riyans WebTech. This consists of, but is not limited to, Spam/ Unsolicited Commercial Email (UCE), warez, piracy, sharing a copy of a copyrighted work without the copyright holder’s consent, and other unlawful applications. The sole decision-maker will be Riyans WebTech on what constitutes a violation of the same. You testify that you are not going to perform the delivered work as an activity of dishonesty: non-compliance can result in service termination and reporting to law enforcement.

3. Child Pornography

In case of Riyans WebTech detecting any child pornography, sexual exploitation of minors, or any other illegal content in any of the files, accounts, or content supplied by you or produced under the engagement, your project will be automatically terminated and not refunded. Such personal information will be transferred to the police, and Riyans WebTech will fully collaborate with the police in any country of the world.

4. Hacking / Denial of Service / Sniffing / Spoofing

Riyans WebTech does not allow writing or implementing the code that is meant to execute hacking, DoS/DDoS attacks, packet sniffing, spoofing, cracking passwords, or any other malicious code. Any such activity will lead to the end of the engagement without a refund and could be reported to law enforcement. Riyans WebTech is the ultimate judge of what should be considered as an abusive or malicious activity.

5. Backup & Project File Restoration

A fee can be charged to assist and retrieve your project files in case your project is cancelled or suspended due to non-payment. Riyans WebTech usually keeps the backup of the project for a maximum of 30 days after cancellation, though it cannot be assured after 30 days.

6. Website Design & Development Service Restrictions

To sustain performance, security and professional standards in the client projects, Riyans WebTech imposes the following limitations on deliverables and use in case it is relevant to the engagement:

• Background processes and services that are meant to be executed on shared platforms are not to be delivered.
• Riyans WebTech does not accept or accommodate projects whose main aim is to store files or file sharing, or even file-exchange services to the whole world, unless a separate hosting/ storage contract is signed.
• Projects must not be established to send bulk email or mass mailing services via common client web sites, transactions, or marketing email should be managed using dedicated email service providers and validated accounts.
• P2P delivery services such as BitTorrent are not allowed to use it as a primary delivery mechanism of client web content.

7. Media, Project File & Disk Guidance

To ensure the seamless execution of the project and the functionality of the site, Riyans WebTech suggests that:

• Most of the content available on the sites will be mainly HTML/textual and optimized to be delivered through the web.
• Before making any submission, significant media assets such as images, video, and audio need to be optimized, and the size of holdings above 500 KB needs to be negotiated.
• In case of large media libraries or archival storage, a separate hosting, CDN or storage solution will need to be contracted – this cannot be included in standard services of website development.

The excessively high numbers of files/inodes or large databases might demand alternative infrastructure (VPS, dedicated server, cloud storage) and might be associated with extra expenses.

8. WordPress, Plugins & Modules

Should the project include WordPress or a CMS of other types?

• Riyans WebTech will also recommend the choice and settings of the plugins. Certain caching or performance modules may have problems when using shared or limited infrastructure; some caching modules or aggressive cache settings on the server side cannot be used unless an appropriate hosting environment is made available.
• The client has the responsibility to provide security, updates, and maintenance to the third-party plugins unless maintenance can be offered with a different support/maintenance agreement.

9. Hosting, “Unlimited” Storage & Email

Basic design and development services do not include hosting, registering domain names and hosting corporate email addresses unless clearly mentioned in the project agreement.

• The validity of any language stating unlimited hosting in the previous drafts is null unless the contract actually contains a hosting product.
• To store emails and provide email services to a large company, we suggest considering transferring to Email Hosting Plans or the services of a third-party email service (e.g., Microsoft 365, Google Workspace). Web-based deliveries of projects are not meant to serve as long-term mail storage in the corporation.
