Acceptable Use Policy

1. Scope

This Acceptable Use Policy (“Policy”) applies to all website design, website development, website maintenance, SEO, digital marketing, online advertising, graphics, technical support, consulting, and other associated digital services (collectively referred to as the “Services”) provided by Riyans WebTech.

Unless specifically agreed in writing, standard website design and development Services do not include web hosting, domain registration, email hosting, cloud storage, CDN services, or server infrastructure.

By purchasing or using our Services, the Client agrees to comply with this Policy, applicable laws, regulations, and the terms of the applicable service agreement or invoice.

2. Prohibited and Illegal Activities

Riyans WebTech does not permit its Services, websites, systems, code, infrastructure, or digital marketing services to be used for unlawful, fraudulent, deceptive, or abusive activities.

Prohibited activities include, but are not limited to:

• Spam or unsolicited commercial email (UCE).
• Warez, piracy, or unauthorized distribution of copyrighted material.
• Distribution or publication of content without the necessary rights or permissions.
• Fraud, scams, phishing, impersonation, or deceptive practices.
• Malware, viruses, ransomware, spyware, or other malicious software.
• Activities intended to compromise or damage computer systems, networks, websites, or services.
• Any activity that violates applicable laws or regulations.

Riyans WebTech reserves the right to determine whether a particular activity constitutes a violation of this Policy and may suspend or terminate the applicable Services where reasonably necessary.

3. Child Sexual Abuse Material and Exploitation

Riyans WebTech strictly prohibits the use of its Services for child sexual abuse material, sexual exploitation of minors, grooming, or any other unlawful activity involving minors.

If Riyans WebTech becomes aware of such material or activity associated with a Client project, account, website, files, or Services, Riyans WebTech may immediately suspend or terminate the relevant Services without refund, subject to applicable law.

Where legally required or appropriate, Riyans WebTech may preserve relevant information and cooperate with competent law-enforcement or regulatory authorities.

4. Hacking, Attacks and Malicious Activities

Riyans WebTech does not permit the development, deployment, or implementation of code or systems intended to facilitate:

• Hacking or unauthorized access.
• Password cracking or credential theft.
• Denial-of-Service (DoS) or Distributed Denial-of-Service (DDoS) attacks.
• Packet sniffing or unauthorized interception of communications.
• Spoofing or impersonation.
• Malware distribution.
• Unauthorized scanning or exploitation of systems.
• Cryptocurrency mining without explicit authorization.
• Any other malicious or unauthorized activity.

Legitimate security testing may be undertaken only where the Client has appropriate authorization and the scope has been agreed with Riyans WebTech in advance.

Violation of this section may result in immediate suspension or termination of the Services without refund and, where appropriate or legally required, reporting to relevant authorities.

5. Non-Payment, Overdue Invoices and Suspension of Services

Payment of all invoices is a fundamental requirement for continued provision of Services.

If any invoice issued by Riyans WebTech remains unpaid after its due date, Riyans WebTech reserves the right to temporarily suspend the Client’s website and/or any associated Services.

Depending on the nature of the engagement, suspension may include:

• Temporary shutdown or disabling of the website.
• Suspension of website development or maintenance work.
• Suspension of SEO Services.
• Suspension of digital marketing and advertising management Services.
• Suspension of technical support.
• Suspension of updates, modifications, or other ongoing Services.
• Suspension of other Services associated with the Client’s account or project.

The website and all associated Services will remain suspended in accordance with Riyans WebTech’s company policy until the full outstanding payment is received and the account is cleared.

Riyans WebTech may, where technically possible, provide reasonable notice before suspension. However, immediate suspension may occur where an invoice is significantly overdue, repeated payment defaults have occurred, or Riyans WebTech reasonably determines that continued service presents a financial, operational, or security risk.

Payment of an overdue invoice does not necessarily guarantee immediate restoration where additional verification, administrative processing, or technical restoration work is required.

Any restoration, backup recovery, migration, or additional technical work required following suspension may be subject to additional charges.

6. Cancellation and Termination

Riyans WebTech may suspend or terminate Services where the Client:

• Fails to pay outstanding invoices.
• Violates this Policy or the applicable service agreement.
• Uses the Services for illegal or abusive activities.
• Provides false, misleading, or fraudulent information.
• Attempts to compromise Riyans WebTech’s systems or third-party systems.
• Uses the Services in a manner that creates significant security, legal, operational, or reputational risk.

Termination or suspension resulting from a Client’s breach, illegal activity, or non-payment does not automatically entitle the Client to a refund for amounts already paid.

7. Backup and Project File Restoration

Riyans WebTech may maintain backups of project files for operational and recovery purposes. However, backups are not guaranteed unless a specific backup or maintenance service has been purchased.

Following cancellation or suspension of a project, Riyans WebTech may retain available project backups for up to 30 days, unless otherwise agreed in writing.

After this period, project files or backups may be permanently deleted without further notice.

If restoration or retrieval of archived project files is technically possible, Riyans WebTech may charge an additional restoration or recovery fee.

8. Website Design and Development Restrictions

To maintain security, performance, reliability, and professional standards, certain projects or functionality may not be supported under standard website design and development Services.

Unless separately agreed in writing:

• Background processes or continuously running services intended for shared or limited environments are not included.
• Websites primarily intended for worldwide file storage, file sharing, or file-exchange services are not included.
• Public file-hosting platforms are not included in standard website development Services.
• Bulk email or mass-mailing systems must use appropriate dedicated email delivery providers and properly authenticated accounts.
• Peer-to-peer delivery systems such as BitTorrent must not be used as the primary delivery mechanism for Client website content.
• Applications that require unusually high server resources, persistent processes, or specialized infrastructure may require separate infrastructure and additional charges.

9. Media, Files, Storage and Disk Usage

Clients are responsible for providing appropriately optimized website content.

Large images, videos, audio files, documents, and other media should be optimized before being provided for website implementation.

Individual media files exceeding approximately 500 KB may require optimization or prior discussion depending on the project’s technical requirements.

Large media libraries, archives, downloads, video platforms, file storage, or high-volume content delivery may require separate hosting, CDN, object storage, VPS, dedicated server, or cloud infrastructure.

Such infrastructure and associated costs are not included in standard website design and development Services unless expressly stated in writing.

Excessive numbers of files/inodes, unusually large databases, high traffic, or resource-intensive applications may also require migration to alternative infrastructure at additional cost.

10. WordPress, CMS, Plugins and Third-Party Software

Where a project uses WordPress or another CMS, Riyans WebTech may recommend suitable themes, plugins, modules, extensions, and configuration settings.

However:

• Third-party plugins and software may have their own licensing terms.
• Riyans WebTech does not guarantee the continued availability, compatibility, security, or functionality of third-party software.
• Plugin and CMS updates may sometimes cause compatibility issues.
• Security updates and maintenance are the Client’s responsibility unless a separate maintenance agreement has been purchased.
• Premium plugin, theme, API, software, or third-party subscription costs are not included unless expressly stated in the project agreement.
• Certain caching, optimization, or server-level modules may require an appropriate hosting environment.

11. Hosting, Domain and Email Services

Basic website design, development, SEO, and digital marketing Services do not automatically include:

• Web hosting.
• Domain registration or renewal.
• SSL certificates where separately chargeable.
• Corporate email hosting.
• Cloud storage.
• CDN services.
• VPS or dedicated server infrastructure.

Such Services will only be provided where specifically included in the applicable proposal, quotation, invoice, or written agreement.

Any previous reference to “unlimited hosting,” “unlimited storage,” or similar wording is not applicable unless a specific hosting product or written agreement expressly provides for it.

For business email, large mailboxes, or long-term corporate email storage, Riyans WebTech may recommend dedicated services such as Microsoft 365, Google Workspace, or another appropriate email provider.

12. SEO and Digital Marketing Acceptable Use

Riyans WebTech provides SEO and digital marketing Services using commercially reasonable and industry-standard practices.

Riyans WebTech does not guarantee:

• A specific Google ranking.
• A specific number of leads, sales, visitors, impressions, or conversions.
• Permanent search engine positions.
• Approval of advertisements or advertising accounts by third-party platforms.

Clients must not request or require Riyans WebTech to engage in fraudulent, deceptive, manipulative, or unlawful marketing practices.

Any advertising platform, search engine, social media platform, or third-party service may independently modify its policies, algorithms, approval requirements, or account status.

13. Client Content and Responsibility

The Client is responsible for ensuring that all content, images, videos, documents, trademarks, logos, data, and other materials supplied to Riyans WebTech are lawful and that the Client has the necessary rights, permissions, licenses, and authorizations to use them.

The Client remains responsible for the legality and accuracy of information published on their website or used in their marketing campaigns.

Riyans WebTech is not responsible for unlawful or unauthorized content supplied by the Client.

14. Third-Party Services

Some projects may depend on third-party services, APIs, payment gateways, hosting providers, advertising platforms, plugins, software, social media platforms, email providers, or other external services.

Riyans WebTech cannot guarantee the uninterrupted availability or functionality of third-party services and is not responsible for outages, policy changes, account suspensions, API changes, pricing changes, or other issues caused by third-party providers.

15. Communication and Messaging Consent

By submitting contact details, placing an order, requesting Services, or signing up for communication from Riyans WebTech, the Client may receive service-related communications through available channels, including:

• Email.
• SMS.
• WhatsApp.
• RCS Business Messaging.

Such communications may include:

• Order and invoice updates.
• Project updates.
• Service notifications.
• Appointment or support notifications.
• Interactive business messages, where supported.
• Important account or service alerts.

Clients may opt out of non-essential marketing communications at any time by replying “STOP” where supported or by contacting contact@riyans.in.

Service-critical communications, including payment reminders, security notices, account suspension notices, and other necessary transactional communications, may continue where legally permitted.

Riyans WebTech will handle personal information in accordance with its applicable Privacy Policy and reasonable data-security practices.

16. Enforcement

Riyans WebTech reserves the right to investigate suspected violations of this Policy.

Depending on the circumstances, Riyans WebTech may:

1. Request corrective action from the Client.
2. Temporarily suspend specific Services.
3. Temporarily disable a website or associated service.
4. Terminate the applicable Service agreement.
5. Remove or disable prohibited content where technically possible and legally appropriate.
6. Preserve relevant information.
7. Report suspected illegal activity to appropriate authorities where required or considered appropriate.

Riyans WebTech’s decisions regarding the application of this Policy will be made in accordance with the applicable agreement, applicable law, and the circumstances of the matter.

17. Policy Changes

Riyans WebTech may update this Acceptable Use Policy from time to time to reflect changes in its Services, technology, security requirements, legal obligations, or business practices.

The latest version published by Riyans WebTech will apply to Services provided after the effective date of the updated Policy, subject to any applicable contractual requirements.
